At Ride Every Stride Inc. we strive to provide the best customer service experience. Creating your customized product is important to us. Please note the following terms and conditions with respect to custom products manufactured by Ride Every Stride Inc.

 

Ride Every Stride Inc. produces and manufactures custom products. There may be slight variations in the colour or texture of the final product.

 

Invoices must be paid in full and proofs approved for production to be initiated.

 

All custom products are FINAL SALE.

 

Finished branded and custom products may be photographed and posted on Ride Every Stride Inc.'s social media platforms or Ride Every Stride Inc.'s website for the purpose of advertising.

 

Ride Every Stride Inc. shall not be liable for consequential damages of any nature with respect to any product or service rendered, delivered or sold.

 

Terms of Use

You are granted permission to access and use this website and its content for the sole purpose of preparing, evaluating, and ordering products or services solely through Ride Every Stride Inc. (referred to herein as “Products”). No other download, retention, use, publication, or distribution of any portion of the content is authorized or permitted. Obtaining products from Ride Every Stride Inc. does not entitle you to use any portion of content, apart from the finished printed, engraved or embroidered products as they are supplied to you by Ride Every Stride Inc.

 

You agree to use this website in a responsible manner that is in full compliance with these terms of use and with your local laws and regulations, including export and import regulations. Without limitation, no portion of content may be utilized as a trademark or service mark, for any unlawful purpose or use, to defame any person, to violate any person’s right of privacy or publicity, to infringe upon any copyright, trade name, trademark, service mark or other intellectual property, right of any person or entity.  You agree that you will not use this website to produce products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious or otherwise objectionable.  Ride Every Stride Inc. reserves the right in its sole discretion, to refuse to accept any content provided by you to Ride Every Stride Inc. or to process any order at any time, for any reason. Ride Every Stride Inc. may also terminate its service to customers found to be using Ride Every Stride Inc. to engage in undesirable activities or otherwise violating these terms of use. You agree that Ride Every Stride Inc. shall have no liability of any kind to you or to any third party arising from such refusal or termination.

Certain weights, measures and similar descriptions are approximate and are provided for convenience purposes only.  Furthermore, all product and service recommendations are for convenience and informational purposes only.  Ride Every Stride Inc. makes all reasonable efforts to accurately display the attributes of our products, including the applicable colours; however, colours displayed on computer screens are dependent on system settings.  Ride Every Stride Inc takes no responsibility for screen settings and does not guarantee accuracy of colour depiction.  The inclusion of any products or services on this website at a particular time does not imply or warrant that these products or services will be available at any time.  Product shown on models in the lifestyle images presented on the website may not be available.

Use of Content

It is the customers sole responsibility for use of content in combination with any images, graphics, text or other materials incorporated into requested/purchased products. The customer agrees to not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your products unless you have obtained the appropriate authorizations from the owners.  The customer warrants that the requested/purchased products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into all requested/purchased product.  By placing an order via this website or through electronic mail to Ride Every Stride Inc., you warrant that you have all necessary permissions, rights and authority to place the order, and you authorize Ride Every Stride Inc. to produce the products on your behalf.  The customer grants Ride Every Stride Inc. the right to copy, modify, distribute, use, create derivative works of and vectorize any content provided for the purpose of fulfilling the requested order and/or marketing products or services.  Moreover, the customer warrants that sufficient rights to permit Ride Every Stride Inc. to copy, distribute, use, modify, create derivative works of and vectorize any content for the purpose of fulfilling the requested order and/or marketing products or services have been obtained.

 The customer assumes all responsibility for any copyrighted material used. Ride Every Stride Inc. assumes no responsibility for designs supplied by the client.

 

Customer/Client responsibilities

 

Deign approval

It is the customers responsibility to thoroughly review final designs for approval. Ride Every Stride Inc. is not responsible for errors found postproduction.  With regard to orders placed online, if no response is received within 72 hours of processed proofs, Ride Every Stride Inc. will assume the placed online order is accurate and final.  All orders will be processed and shipped accordingly.  Any customer oversights in the ordering process (i.e. spelling, logo selection, address) will not qualify for a refund or reproduction at Ride Every Stride Inc’s. expense.

 

Legality

It is the customers responsibility to ascertain and obey all applicable local, provincial, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any item purchased from this website.  By placing an order, you represent that the products ordered will be used only in a lawful manner.

 

Design Services

The designer retains ownership of all original preliminary artwork that is not the final design chosen by the customer/client.

 

The customer/client shall indemnify the designer against all claims and expenses, including attorney’s fees, due to the uses for which no release was requested in writing or for uses that exceed authority granted by a release.

 

The designer warrants and represents that, to the best of his/her knowledge, the work assigned hereunder is original and has not been previously published, or that consent to use has been obtained on an unlimited basis; that all work or portions thereof obtained through the undersigned form third parties is original or, if previously published, that consent to use has been obtained on an unlimited basis; that the designer has full authority to make this agreement; and that the work prepared by the designer does not contain any scandalous, libelous, or unlawful matter. This warranty does not extend to any uses that the customer/client or others may make of the designer’s product that may infringe on the rights of others.  The customer/client expressly agrees that it will hold the designer harmless for all liability caused by the customer/client’s use of the designer’s product to the extent such use infringes on the rights of others.

 

Shipping

When an order is placed, it will be shipping to an address designated by the purchaser.  All purchases placed via this website (rideeverystride.com), through a direct electronic mail purchase, or verbal, are made pursuant to a shipment contract.  As a result, risk of loss and title for items purchased from this website, through electronic mail, or verbal, pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments. Ride Every Stride Inc. employs Canada Post and UPS as primary shippers. For any product that is to be provided to the customer in an electronic format, the customer agrees that delivery of such product shall be deemed to have occurred at the time we transmit the product via electronic mail or any other electronic communication addressed to the customer.

 

If free shipping is provided as part of a purchase agreement, Ride Every Stride Inc. will use the most economical method of shipping unless otherwise requested.  This also includes basic insurance coverage for the shipped goods unless otherwise requested.  Ride Every Stride Inc. assumes no liability for lost or stolen items in any shipment above and beyond the coverage provided by the shipping company.​

 

Ride Every Stride Inc. offers customers/clients the choice of standard or express shipping, with the option to opt out of tracking on basic shipping.  Insurance coverage on shipping is based on the type of shipping selected.  Additional coverage may be added upon customer/client request for an additional fee.  Once deliverable products are being handled by the chosen shipper, Ride Every Stride Inc. is not responsible for lost or stolen items pre-delivery, post delivery or in transit. Please note that packages delivered without a signature requirement are at much greater risk for theft.  If there is any concern regarding the delivery of a package, it is recommended that a signature upon delivery is requested for the deliverables to the shipping company via Ride Every Stride Inc.  This request will be reflected in the cost of shipping incurred by the customer/client.

 

​ Ride Every Stride Inc. is not responsible for any shipping delay’s due to increased holiday volume, poor weather conditions, customs delays, or other unforeseeable events outside reasonable control.

 

Indemnification

 

The customer/client agrees to indemnify Ride Every Stride Inc. and all parties from whom Ride Every Stride Inc. has licensed portions of content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these terms of use or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material that was not part of the standard site content and that was uploaded or otherwise provided to Ride Every Stride Inc. or incorporated into products.  As to clause (ii), customer/client agrees that Ride Every Stride Inc. has the right to control the defense of any such suit, claim or demand.

Governing Law

The party you are contracting with and the seller of the products and services offered and sold on this website is Ride Every Stride Inc. a Canadian corporation, a company organized under the laws of Canada with its headquarters in Rockwood, Ontario, Canada.  All issues related to the protection, infringement, or misuse of copyrighted materials shall be governed by the copyright laws of Canada.  All other matters relating to access to or use of this website shall be governed by the laws of Canada.  Any legal action or proceeding relating to or arising from access to or use of this website shall be instituted in Ontario, Canada. The customer/client agrees to submit to the jurisdiction of courts sitting in Ontario, Canada and agrees that venue in these courts is proper in any such legal action or proceeding. The customer/client also agrees not to assert in any legal action or proceeding involving Ride Every Stride Inc. where a court sitting in Ontario, Canada is an inconvenient forum for such legal action or proceeding.

 

Warranty Disclaimer

Unless otherwise listed in this agreement, products are provided "AS IS,".   No Warranty, whether implied or expressed is extended to the customer/client or purchaser by Ride Every Stride Inc. or chosen vendors, unless otherwise listed in this agreement,

(a)  Ride Every Stride Inc. does not make any warranty regarding any product.

(b)  Ride Every Stride Inc. disclaims to the [fullest] extent authorized by Law any and all [other] warranties, whether express or implied, including any implied warranties of [title, non-infringement, quiet enjoyment, integration,] merchantability or fitness for a particular purpose.

 

Miscellaneous

You must be at least 18 years old or otherwise have parent or guardian permission to use this website. By using this website, you represent and warrant that you are at least 18 years old or have the above noted permission.  In the event any provision hereof is found to be unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the extent necessary to allow enforceability of the provision as so limited, or, if a deemed modification is not satisfactory in the judgment of that court, the unenforceable provision shall be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected thereby.
